The Contracts Manager acts as the middle point between SCM, Projects and the Vendors with the responsibility to manage contracts to reduce the likelihood of receiving claims from contractors. The incumbent must ensure that contractors deliver based on baselined project schedules, assist with compiling of the POP strategy and setting up of contract requirements so that SCM can issue enquiries. As a Contracts Manager for Projects in construction, oversee projects from the start through to completion, ensuring that work is completed on time and within its budget. DUTIES&RESPONSIBILITIES Audit Management Audit contractor schedules, progress reports, site instructions and other project documents on an ongoing basis to determine progress against baselines (Performance) Implement corrective actions were required to correct gaps identified that can place a risk on Exxaro Maintain contractual records and documentation such as receipt and control of all contract correspondence, customer contact information sheets, contractual changes, status reports and other documents for all projects Business Operations Put together plans and estimates, including budgets and timescales in alignment with client needs. Prepare and present documents for tenders Contribute to work planning, and brief project teams, contractors and suppliers. Agree any extra work to be done within set timescales Gather all information together for invoicing at the end of the Project. Supply information to resolve disputes if they arise. Identify areas for improvement in existing contracting processes Compliance, Governance and Assurance Align agreements with SCM strategy, budget and corporate governance. Facilitate and develop General Conditions as well as clauses applicable to regulations and legislation Ensure compliance to policies, systems, procedures and legislation and adhere to sound corporate governance principles Implement portfolio targets in alignment with legislation and charters (e.g. Mining Charter, BBBEE, SHE etc) Ensure Quality Assurance on BU Own contracts and provide guidance to Contract Specialists Identify, manage and mitigate risk associated with supply chain's procurement initiatives Contract Management Identify and eliminate contractual risks. Drive contracting strategies and contract coverage plan Provide commercial and financial inputs to evaluation process. Guide and conclude fit for purpose contracts. Verify contract scope terms and conditions Facilitate contract coverage targets and improvement plans. Develop and implement measures and initiatives to ensure improved supplier performance Facilitate contract management scorecard and performance improvement. Provide commercial and financial inputs to evaluation process Approve or seek approval for relevant contracts and documentation in line with departmental budgetary stipulations Identify and validate reporting needs for contract management capability Customer and Client Relationship Management Provide relevant and specialised contract management support Liaise with operational personnel on equipment deliveries and requirements Represent Exxaro at applicable project and contractor meetings. Align contracting strategies and priorities with requirements of BU's Liaise with external providers and relevant stakeholders to address, manage and resolve issues and risks relating to contract portfolio. In consultation with stakeholders, define appropriate supplier selection criteria and seek approval for supplier selection decisions Effective People Management Responsible to manage Contract Administrators Engage with various stakeholders on the project including: Project Manager, Construction Managers, Project Planners, Project Accountants, Contractors, SCM, Client Team, Engineers, Suppliers and Consultants Create an environment that focuses on process execution excellence, high performance and improvement. Provide inputs for efficient development, career path and deployment of contract specialist and commercial specialists Recruitment, performance management and coaching of staff members Contribute to execution of Supply Chain strategy and targets Develop and implement contract lifecycle processes and controls. Ensure formulation, execution and management of a portfolio of contracts Define portfolio targets and contribute to/align with various BU procurement strategies. Assess business requirements, end-user needs and supply market capabilities. Leverage spend opportunities across relevant BU's. Define and manage portfolio improvement initiatives. Identify and investigate impact of key industry and technological trends on portfolio. Ensure reliable market intelligence to identify and develop supply strategies and budget inputs to ensure secured supply of critical/ strategic commodities. Encourage a culture that focuses on safety in all operation System Maintenance and Support Work with relevant project management systems and ensure proper integration required for managing contracts Ensure compliance to Exxaro EWPM framework with regard to project systems and processes MINIMUM QUALIFICATIONS&REQUIREMENTS: BCom degree with commercial background (Essential/Minimum) 8 years relevant construction and commercial experience with an understanding for the principles of GCC / FIDIC / NEC contract conditions.
